The laws governing content regulation on television were discussed in detail. The participants were given an overview of: (a) the Programme Code & Advertising Code; and, (b) the regulations/guidelines prescribed by IBF and ASCI. Further, the provisions of the ‘Programme Code’ and ‘Advertising Code’ were tested on the touchstone of Article 19(2) of the Constitution of India to ascertain the reasonableness and legality thereof. A detailed presentation on concept of content regulation with regard to OTT platforms. Discussed the following (a) Definition and market share (b) laws in force that casts an impact on the content shown on OTT platforms (c) steps taken by the government to frame laws for OTT platforms (d) The IAMAI Code (e) Pre-censorship on OTT platforms, followed by queries that were duly resolved.
